Terms of Services

• Project Initiation & Payment Terms –
1. A minimum of 50% advance payment is required to start the project.
2. The remaining payment must be cleared before final delivery or website launch.
3. All payments made are non-refundable once the project has started, except in cases of proven technical failure caused solely by our team.
4. Project timelines begin only after full advance payment and receipt of all necessary materials (content, images, credentials, etc.) from the client.
• Client Responsibilities –
1. The client must provide accurate and complete project information, including text content, images, and required details.
2. Delays in providing information or feedback may result in extended project timelines.
3. The client is responsible for ensuring that all provided content (images, text, videos) is legally owned or licensed for use.
• Revisions & Modifications –
1. Clients are entitled to a specified number of revisions during the design phase, as outlined in the project proposal.
2. Additional revisions beyond the agreed scope may incur extra charges.
3. All requests for changes must be submitted in writing and may impact project timelines.
• Ownership & Rights –
1. Upon full payment, the client will receive complete ownership rights to the final website design and files.
2. Graphicodx reserves the right to use completed projects for portfolio and marketing purposes unless otherwise requested in writing by the client.
• Domain, Hosting & Maintenance –
1. Domain registration and hosting are not included in website development costs unless specified.
2. The client is responsible for renewing hosting, domain, and SSL certificates on time.
3. Free maintenance/support is provided for the duration mentioned in the selected plan; additional maintenance will be chargeable.
• Website Launch & Delivery –
1. Graphicodx will host the website temporarily for review and testing before final deployment.
2. Once final payment is received, the website will be launched on the client’s domain/server.
3. After launch, any issue caused by third-party interference (plugins, hosting errors, malware, etc.) will not be covered under free support.
• Third-Party Tools & Integrations –
1. Integration of external APIs, plugins, or payment gateways may incur additional costs.
2. Graphicodx is not responsible for downtime, data loss, or errors caused by third-party service providers.
• Project Cancellation Policy –
1. If a project is cancelled by the client after initiation, the advance payment is non-refundable.
2. If Graphicodx cancels the project due to unforeseen circumstances, the client will be refunded proportionally based on incomplete work.
• Confidentiality –
1. Both parties agree to keep all project-related information confidential and not disclose it to any third parties without prior consent.
2. Both parties agree to maintain strict confidentiality of all shared business, technical, and personal data.
• Limitation of Liability –
1. Graphicodx will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the website.
2. Graphicodx is not responsible for any loss of data, revenue, or business due to website downtime or technical issues.
• Governing Law & Dispute Resolution –
1. These terms shall be governed by and construed in accordance with the laws of India.
2. Any disputes arising from these terms will be resolved through mutual discussion; if unresolved, they will be subject to the jurisdiction of courts in Kolkata, India.
